Welcome to Gaja Earth, an online shop operated by Gaja's Vintage, owned by Gaja Bohte.
These Terms of Service apply to your use of the Gaja Earth website and to purchases made through our online shop.
By using our website or placing an order, you agree to these Terms of Service.
Our Privacy Policy, Shipping Policy and Withdrawal/Refund Policy form part of the information governing your use of our shop and purchases.
1. About Gaja Earth
Gaja Earth is an online clothing shop operated by Gaja's Vintage.
We offer a selection of new and pre-loved clothing and other items that have been personally sourced and selected for the shop.
Some products are originally manufactured by third-party brands or manufacturers. Gaja Earth is not necessarily the manufacturer or brand owner of those products. We sell these products as a retailer/reseller.
2. Our products
We make every effort to photograph and describe our products as accurately as possible.
Colours and appearance may vary slightly depending on your screen, device and settings.
Product descriptions, measurements, materials and other information are provided to help you make an informed purchasing decision.
3. Pre-loved and second-hand items
Some products sold through Gaja Earth are pre-loved or second-hand garments that have previously been owned and worn.
Because of this, these items may show signs of previous use.
Any noticeable defects, marks, stains, repairs, alterations or other significant signs of wear known to us will be described and, where appropriate, shown in photographs in the individual product listing.
We encourage you to read the full product description and look carefully at all photographs before placing an order.
Normal signs of previous use that have been clearly disclosed in the product listing do not constitute an undisclosed defect.
Your statutory consumer rights regarding defective goods remain unaffected.
4. Product availability
We try to keep the availability information on our website accurate.
If a product becomes unavailable or we are unable to fulfil an order, we will contact you and refund any payment already made for the affected order where appropriate.
We reserve the right to correct obvious errors in product information or pricing.
5. Placing an order
When you place an order through our website, you submit an offer to purchase the products in your order.
After receiving your order, you will receive an automatic confirmation that we have received your order.
This confirmation does not necessarily mean that your order has been accepted.
The purchase contract is concluded when we accept your order and confirm the purchase, or when we otherwise begin fulfilling the order, depending on the checkout process used.
If we are unable to accept your order, we will inform you as soon as reasonably possible and refund any payment already made.
6. Prices and payment
All prices shown in the shop are the prices applicable at the time of purchase.
As a small business under § 19 UStG (German VAT Act), we do not charge or show VAT separately.
Shipping costs are shown separately where applicable.
The payment methods available to you are displayed during checkout. These may include card payments, Shop Pay, Apple Pay, Google Pay and other payment methods made available through Shopify depending on your location.
Payment processing is handled through Shopify and the relevant payment provider.
7. Shipping and delivery
We ship orders using the shipping methods displayed during checkout, including DHL where applicable.
Estimated delivery times are provided for guidance and may vary depending on the destination, shipping provider and circumstances outside our control.
We will provide you with available shipping information and, where applicable, tracking information.
We cannot be held responsible for delays caused by events outside our reasonable control, such as disruptions affecting shipping carriers, customs authorities or other unavoidable events.
However, your statutory consumer rights concerning delivery, delays and cancellation remain unaffected.
8. Withdrawal and returns
If you are a consumer and the statutory right of withdrawal applies to your purchase, you have the right to withdraw from the contract within the applicable statutory withdrawal period.
The details of your withdrawal rights, the withdrawal period, how to exercise your right and information about returning goods are set out in our Withdrawal Policy.
Nothing in these Terms limits any statutory withdrawal rights you may have.
9. Statutory rights regarding defective goods
Nothing in these Terms affects your statutory rights as a consumer.
If a product is defective or does not correspond to the agreed condition, you may have statutory rights under German consumer law.
For pre-loved products, any known and clearly disclosed signs of previous use will be described in the product listing.
10. Customer accounts
Some features of the shop may allow you to create a customer account.
You are responsible for keeping your account information accurate and for taking reasonable steps to keep your account credentials secure.
You should contact us if you believe that your account has been accessed without your permission.
11. Website content and intellectual property
The content created specifically for Gaja Earth, including our photographs, original text, graphics, branding, logos and website design, belongs to Gaja's Vintage/Gaja Earth or is used with permission.
You may view and use the website for your personal, non-commercial shopping purposes.
You may not reproduce, distribute, modify or commercially use our original website content without our permission.
Product names, brand names, trademarks and other intellectual property belonging to third-party brands remain the property of their respective owners.
12. Third-party services and links
Our shop is powered by Shopify and may use third-party services to provide payment, shipping, marketing, analytics and other functionality.
Our website may also contain links to third-party websites or social media platforms.
We are not responsible for the content, availability or privacy practices of websites that we do not control.

We are not responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, such as natural disasters, serious disruptions to transport or postal services, strikes, government measures or major technical failures.
We will take reasonable steps to resume performance as soon as possible.

We may update these Terms from time to time, for example if our shop, services or legal requirements change.
The version applicable to your purchase is the version in force when the relevant contract is concluded, unless a later change is required by law or otherwise agreed with you.
The current version of these Terms will always be available on our website.
17. Applicable law
These Terms are governed by the laws of the Federal Republic of Germany.
If you are a consumer who normally lives in another country, you continue to benefit from any mandatory consumer protection provisions that apply in your country of residence.
